I am hoping for some guidance how to proceed in the following situation:

Learner is aged 18 at start.

Learner started apprenticeship: 29/9/2023

Learner went on a Break in Learning: 27/9/2024

Learner eventually withdrawn : 27/9/2024 

The withdrawal date is day 365 of the apprenticeship, last date of learning. 

The employer stopped the DAS from September 2024 without consultation with us. 

No EAP was triggered in September/October.

The learner has found a new employer so would like to restart to go through EPA and the new employer is querying if they would be eligible to receive the 2nd EAP, assuming it is triggered to be paid once the learner has restarted the apprenticeship.    

I have asked the DAS support team and they have referred me to the Technical Funding Guide which states:

"We will split these payments into 2 equal payments when the apprentice is still in learning at 90 days and 365 days. You must pass on the payment to the employer as required in the apprenticeship funding rules." 

The Funding rules statement is :

99.2  - "365 days after the apprentice starts, the remaining 50% will be paid if the apprentice is still undertaking their apprenticeship."

Am I correct in thinking the new employer would be eligible for the remaining 50% once the apprenticeship restarts?
