we are aware some providers offer incentives to attract apprentices/employers with freebies, e.g. amazon vouchers and my marketing team have asked if they can do something

This makes me very uncomfortable and I have gone back with the rules;

 108.10.1 Financial inducements, or any other payment not authorised by us, must not be paid to an apprentice, employer, another training provider or to an end-point assessment organisation in relation to any part of the apprenticeship. This includes bonus payments to apprentices or employers for starting or completing an apprenticeship. Where an employer tenders for apprenticeship provision, training extras in excess of the apprenticeship requirements must not be included in the price.

 108.10.2 Providers and subcontractors must not seek or accept financial inducements in relation to the apprenticeship.

 But the above are countered with; 109.1. If the provider (main provider) chooses to use the profit (surplus) that a commercial provider can legitimately earn from eligible costs, on any of these activities, they can choose to do so.

 I have also looked at our DfE contract and am unsure whether these inducements could come under the Bribery Act or Procurement law. Seems dodgy to me but would really appreciate thoughts or any definitive answer to this as really nothing specific in the rules that I can find?
