Eligibility - ASF & Apprenticeship

Hello all,

We have a potential new starter who is currently undertaking an Adult Skills Funded course at a local college and is interested in beginning an apprenticeship in the same subject area. He has approximately two months left to complete the course.

If we reduce the funding we claim to account for the Recognition of Prior Learning (RPL) that will be accredited once the above course is completed, would he be able to begin his apprenticeship before completing the course?

I’ve reviewed the funding guidance, and it appears this might be possible—depending on how the following section is interpreted:

Individuals who are not eligible for funding  

22. A provider must not claim funding for individuals who:   22.4. Are undertaking another apprenticeship; 9 22.5. Are undertaking training funded through the Adult Skills Fund (ASF), where that training will: 22.5.1 22.5.2 22.5.3 22.5.4 Replicate vocational and other learning aims covered by the apprenticeship, including English and maths; Offer career related training that conflicts with the apprenticeship aims; or Be taking place during working hours. Where an apprentice has more than one job, working hours refers to the hours of the job the apprenticeship is linked to. As an exception to paragraph 22.5 an individual may commence an apprenticeship and attract funding, where they have less than four weeks to completion of an existing DfE funded course.

I mean, it sounds like it conflicts with "Replicate vocational and other learning aims covered by the apprenticeship"? Personally, wouldn't start them til they're within four weeks of completing their ASF aim.
