Self employed apprentice

Hi,
We have a construction apprentice who has left their previous employment and now works via an agency on a self employed basis. I appreciate the rules are clear: 22. A provider must not claim funding for individuals who: 22.1. Are self-employed as a sole trader
However - as this apprentice isn't self-employed as a sole trader, are they therefore eligible? (should add that this apprentice is ready for gateway)
Any guidance or clarity would be very gratefully received.
