No they don't because, even though they're freelance, they're still "workers" because you control their work, rather than paying a separate company. Also, they'd have to have a UKPRN if they *were* which would be somewhat excessive!!! From the glossary:
An individual could include a person
who is a sole trader, self-employed, a freelancer or someone who is employed by an
agency, unless those individuals are working under the direct management of the
provider and are controlled in the same way as the provider’s own employees.

Freelance Tutors - Classed as Subcontracting?

Good afternoon all,
I am trying to clarify if freelance tutors are classed as subcontracting? If we were to pay a tutor per learner and they were to invoice us each month, does that class as sub-contracting? If so would it be best that they have a zero hour contract with us and they get paid from our payroll?
