Can you claim NVQ observations as OTJ hours?

We deliver the site supervisor's Apprenticeship with the mandatory qualification being the NVQ. My centre is claiming 2/3 hours for the NVQ site observation. My view is that, as this is a competency-based award, they are displaying their competence, consistently within the observation, thus not classed as new learning. My view would be that the new learning could be claimed in the weeks running up to the observation, where the candidate is "learning" their craft. They feel there is an element of mentoring in the observation, but I disagree; this would then be "leading" the candidate in their duties or through the PD's capturing their knowledge. I was there to observe and capture evidence of their competence purely. Can anyone give a straight answer if the site observation of an NVQ is claimable as new learning/Teaching or simply not?

Peer perspective here! There is a marked difference between Assessment for Learning and Assessment of Learning. Using observation as a technique in AfL is likely to include some modelling/ mentoring and therefore potentially new learning that could be classified as/ contribute towards OTJ. Question is whether this is intended to be developmental AfL, often mid-sequence/ unit/ module, or evaluative AoL, usually towards the end of a sequence/ unit/ module?

My understanding would be that there is learning up to the point of the observations, which could be captured, but not the observation or assessments, as you're assessing competence. The new learning would have been conducted before this point.
