App 25/26 - when OTJH are complete but FS isn't

Thought I'd post this just in case anyone else had fallen down a rabbit hole when trying to apply the 25/26 rules 100% literally.

I noticed that the complete separation of FS and OTJH in the 25/26 rules caused a interesting conundrum if the (16-18) apprentice had completed all the OTJ learning to the required level,  but still not achieved the FS they needed.

A literal reading of the rules means that the learner would still have to do at least 1 hour a month of OTJH while they completed the FS.  But if they've already done all the vocational learning needed, anything further couldn't meet the definition of OTJ as it would either be a repeat of something they've done, or something not actually needed to achieve the apprenticeship.

I put this to the helpdesk and received the following reply:

The Specialist Support team have been in touch today to let us know the following in relation to your OTJT query;
 
As OTJT active learning can be as little as 1 hour per month the rules were written on the assumption that some OTJT (even if it was a small amount as the focus that month was on English and maths) would be delivered each month. 
 
We will account for this scenario in a future version.
 
For now, we are content that if OTJT active learning has been completed (i.e. no more OTJT on the plan) then the BIL rule for that section does not apply.
