How come they don't meet the residency criteria Aashish Dhruv ?
They hold an expired ARC as an asylum seeker. My understanding would be that because of this, we cant determine the validity of their status to remain in the UK, nor can we as the provider confirm that the "...may be unable to complete their programme if they are likely to leave the country permanently during their study programme or T Level.”
Steve Hewitt - Right, but the ARC is an application registeration card, to show that they are an asylum claiment while their claim is pending, so they aren't officially an asylum seeker yet. It does have an expiry date, and they are required to complete a new form if this expires. Therefore, my concern is that we can't confirm the validity of their claim with an expired ARC

Hi,
We have an 18 year old, trying to enrol. However, they do not meet the the residency criteria to complete a qualification with us. However, we dont want them slipping through the cracks, and are trying to determine the best way to still keep them in education. How can we go about this?
I know the funding rules state that fees “…cannot be charged to students aged 16 to 18 in full-time or part-time education by either DfE-funded institutions or their subcontractors.”.
Could we then just create a college certificate but not report it to the ILR? It would be great to hear if other FE colleges have come across a similar scenario and found an acceptable solution? Thank you
