As yet we have not received a response from DFE - the query was escalated by them and am just receiving the usual "we escalated this to our Technical Support Team for further clarification". I can't believe that its takes this long to provide a response to what should be an easy question.
In the meantime we are continuing as before in that last learning also takes place on the Gateway date, unless we hear otherwise

I am seeking clarification The funding rules state the following under the Glossary schedule:-
Final day Defined in legislation as the final day of the practical period. This is the equivalent of the learning end date on the ILR (there must be evidence of learning on this learning end date) and internally it is also referred to as the “gateway” between the practical period and the completion of the end-point assessment. The term ‘final day’ is used as a measure in the redundancy policy to determine if the apprentice will be fully funded to completion.
And then for Gateway is says: See ‘Final day’.
However during a recent webinar there was a presentation from one of the DfE audit firms who informed us that the DfE have said stated that the last day of learning cannot be the same date as the Gateway review date.
I therefore I have the following question:-
Is it acceptable for an apprentice to have a final learning activity (which is linked to their KSBs / OTJ hours target) with the assessor on the same day as the Gateway review meeting, ie this learning activity takes place before the Gateway meeting?
