Can someone please confirm my understanding.

I have an apprentice who was aged 16-18 at the start of their apprenticeship, who started 13/05/24 on a level 2 apprenticeship. They already hold an equivalent to level 1 Maths & English. Can you confirm if it is a mandatory requirement for them to study towards and attempt level 2 functional skills? This is my interpretation.

Our EPAO is saying that they don't have to attempt level 2 Maths and/or English.

EPAOs don't set the Funding Rules! The Funding Rules, as you correctly point out, say that these learners must attempt L2 FS. Note though that, as it's not an EPAO requirement, you don't need to delay Gateway until they've taken the FS test, you can leave FS learning aims open even when you've set the ZPROG to 1&8 (I'm not sure that I'd *recommend* it, but it is possible).
