Employer involvement in Learning Support

Created

None

Hi, we have a few apprentices on degree apprenticeships who require support with dyslexia but do not want their employer to know.
Is there anyway of funding this support without employer consent?

Why do you think you require employer consent?, learning support funding comes direct from the ESFA and is not funded through the Levy or DAS so unless you inform the employer which you can only do with the learners consent it should not be an issue.

Hi Ceri - yes I agree with Martin, we have a number of learners in that position. It is just a flag in your ILR (LSF_1) in Learning Delivery Funding and Monitoring, and/or additional funding in an EAS return.

It is listed as one of the items to be included in the commitment statement template which indicates that employers should be aware.

I would think that would only apply where the apprentice has given permission for the TP to share the information with the employer.

Even though included in the CS template you need not complete this section where the learner does not consent, this is similar to the Care leavers bursary where the following applies but in this case you only need to record on the learner file that the learner does not consent to their employer being informed.

P129 You must include signed consent from the apprentice to inform their employer that they have been in the care of their local authority and tell the apprentice that their declaration will be used to generate additional payments to both the main provider and their employer to support their transition into work.

P130 Where a 19 to 24-year-old apprentice does not want to inform their employer that they were previously in care, then you must report the appropriate code in the ILR. This will generate the funding for you and the apprentice but not the employer. Where this is the case you must not apply the co-investment waiver (see paragraph P133). This means that you must not record the code for the waiver in the ILR.

The problem is that it doesn't actually state for learning support as it does for the care leavers.

I tend to agree with Steven as it is a general rule that you should not share a learners personal information where they do not consent, see Privacy Notice from your organisation and the ESFA.

You can always contact the ESFA for conformation
