Levy to Non Levy - unexpired funds

Hi all! We have an employer who was a levy employer, but is no longer. They still have unexpired funds in their levy pot. Are they OK to use these, assuming the programme completes before they expire? Or would they just revert to shortfall of levy funds scenario if it was profiled over a longer period?
