Restart - same employer - same provider-

Quick question - learner was let go in december and didn't at the time want to continue to Gateway - he only had 1 month left in learning so he was made a leaver.

 He is now able to return and restart.

Issue is he started his APP when he was 18 he will be returning to it as 20yr old. So does the initial age kick in and ensure no co-investment for the 1 month from the employer or do we indeed charge 5% for the 1 month funding we will be claiming.

Obviously, this wouldn't have happened before the restarts for withdrawals became a thing, but, unlike BILs, where it would definitely pick up the initial date (and therefore age), I don't think we use Original Start Date on these ones, only the restart flag, so their age would be recalculated on the new start and, therefore, the 5% would be chargeable.

Very happy to take other views on this though!

I'm not disagreeing with Steve's conclusion here (I don't think...) but this from the PSM makes it seem less clear to me:

Entitlement to 16-18 apprenticeship funding where the learner is 19 or over.
Record EEF code 2 when:
• the apprentice is restarting a programme on or after their 19th birthday and was aged 16 to 19 when they originally started.

It only says restarting a programme and doesn't specify BILs only. And isn't this scenario a restart now?

Good point Matt, although I'm unsure whether that guidance has been thought about since the change to the withdrawal rule... Whilst one would hope it had, there's no easy way to tell!
