For this academic year, she only need to have been in the EEA for three years, not the UK, so if she was in Portugal that's fine. As her status doesn't expire til 2026 then that's also fine.
Definite changes coming to this next year, but they've yet to be published for Apprenticeships.

Residency Query - Limited Leave to Remain

We have a potential learner that would like to complete an Apprenticeship with us, but I am just not sure about her residency status - I think it all sounds okay, but looking for some advice please.
She has a letter from Home Office confirming she has the "Limited Leave to Remain" status or pre-settlement status that does not expire until Feb 2026. She is 18 years old, and also has Portugese passport so EU citizenship.
The Home Office letter does say it's not proof of her status, so we will need the additional evidence from her, but the letter does say that she can work and study in the UK.
The only part of this I am not sure on, is whether she needs to have been in the UK for 3 years? Or if I am missing something else here?
