50% working hours in England

Hi,

We have an apprentice who when enrolled was working in a store based in England. No issues at the time with the rule below as they were eligible.

Spend at least 50% of their working hours in England over the duration of the apprenticeship.

They have completed over 60% of their duration on programme (practical period) and have now informed us they are being relocated to a store in Wales. As they have exceeded 50% of their working hours (based on the planned end) working in England does it matter that the other 40% will be spent in Wales? If we average this out over the whole programme, over 50% of their working hours will be in England. Or does 50% of their working hours have to be in England THROUGHOUT the whole programme duration?

Any insight to other peoples interpretations are welcomed.

That should be ok as they will have spent at least 50% of their working hours in England over the duration of the apprenticeship.

We have a similar issue, where an apprentice who was levy funded is moving from England to Wales in a months time. They are moving employer, and the employer will be in Wales. They have completed over 50% of their working hours in England, and are expected to complete July 2022. If the student continues their apprenticeship, how would we record this in the ILR so their remaining fees are funded?
