This is a slightly contested area. It's not the learners fault they're not allowed to apply to extend until it's nearly expired and have to regularly re-apply.
The trouble comes with para 77.2:
P77.2 Be able to complete the apprenticeship within the time they have
available. If you know an individual is unable to complete the
apprenticeship in the time they have available, they must not be funded.
and the definition of "time they have available". I asked for this to be looked at and clarified a couple of years ago but no change yet. Personally, I'd fund them on the basis that there's no reason to assume the extension to their status won't be granted...
We asked this to an auditor and he said as long as we have evidence the learner has reapplied then that is fine as you can't discriminate against them due to dates on their visa.
With this in mind we have a tracker to record any like this and then obtain confirmation that they have reapplied.

We have an potential apprentice who has provided us with a Residency Permit with the status of Leave to Remain. However the expiry date is prior to the planned end date of the apprenticeship. They have lived in the UK for more than 3 years. Just before the expiry date the potential apprentice intends to re-apply as they have been doing in previous years. Would they be entitled to Apprenticeship Funding?
