Do I need to ask apprentices to prove their Maths and English prior attainment if they have been educated to a degree/masters/bachelor level? Surely by the fact that they have be able to reach this level of higher education they would have passed maths and English at level 2 or higher?

I think you should regardless- although they probably would have needed them to be offered their university place, you as training provider can't really claim to have confirmed this if you're just assuming it.
@martinlocock yes I agree with you. I've just got a tricky situation of someone who is nearly 40 years old enrolling for a level 7 apprenticeship, educated in America for maths and English but holds both a bachelors and masters for the UK!
Yup, degrees aren't considered exemptions, someone could have a PhD in Maths, but if they can't show you their GCSE/A Level cert, they kind of have to do FS...
For the American qualifications you will need to have a comparability statement from ecctis (formerly NARIC) to show that they are equivalent to UK quals.
