Learner Eligibility - Overseas (Sovereign Soil)

Hi All, 

We have a learner who is potentially moving overseas to work. The learner will be working for the ambassador of Kuwait, the office is based in Kuwait but on sovereign soil, British office, dealing in sterling and pay UK taxes etc. Whilst I know of the rule with the funding rule around "Evidence that the apprentice will spend at least 50% of their working hours in England over the duration of the apprenticeship including time spent on off-the-job training", I am more interested in understanding if Offices overseas are within the eligibility of an apprenticeship.

1. This may be the best question ever asked!

2. My gut feeling is "no" it wouldn't count as England, in the same way that if they were posted to Edinburgh or Cardiff it wouldn't count? Unless FCO have a very specific deal with the ESFA about this, but there's no obvious exception.

Steve Hewitt thank you for your response :) I am waiting for the ESFA to reply to the query I sent to see their stance on this but thought I would see what people thought. It's an interesting one!
