Scottish Apprentices

We are tendering for a levy contract with an employer who operate across the UK including Scotland. The majority of their apprentices will be based in England but they have asked if they can use their levy to fund apprentices based in Scotland. These apprentices would not be spending 50% of their working hours in England. Another provider have told them they can!

The funding rule below seems to suggest that it might be possible? Has anyone had any experience of getting permission to do this? Would you start by speaking to the ESFA or Skills Development Scotland.

Or is the funding rule below just saying we would need to apply for a funding contract with SDS because if that's the case I think it's a non-starter.

 P78.7.1 You must make separate arrangements with the relevant devolved administration if you are planning to deliver apprenticeships to individuals who spend more than 50% of their working hours in a devolved administration over the duration of their apprenticeship, including time spent on off the-job training.
