English and Maths Level starting level check

Hi all,
Just checking i'm understanding this rule correctly.
16 year old on a level 2 apprenticeship, cannot evidence any prior attainment, does the initial assessment determines level at which they study at. Thus if they came out at level 1 (higher) on initial assessment then they would go straight to level 2 but would still be required to pass assessments at level 1 if they didnt pass the level 2 functional skill.
I'm finding Paragraph 52 and 54.1.1 slightly contradictory. (26/27 rules). How's other providers dealing with the scenario above?
