If an apprentice is taken on in July but their apprenticeship sign up is not until October,  can they pay apprenticeship wage in July or do they have to pay NMW until October sign up for apprenticeship and then pay the apprenticeship wage?  Funding rules would seem to indicate not, but the 90 days rule regarding the Hiring Grant is confusing some employers and we would like to be able to clarify this for them.

You can only pay the apprenticeship minimum wage when the are an apprentice. They are not an apprentice until the October start date.

Sharon Ward It depends on what you are referring to as your apprenticeship sign-up date. If the apprenticeship agreement has an apprenticeship start date that pre-dates the practical period start date, then the apprentice rate applies from the apprenticeship start date and not the practical period start date. Otherwise, if they are not employed under an apprentice agreement as an apprentice until October then yes they would need to be paid the applicable NMW for their age until the October date.
