I mean definitely definitely not "a date after the 30-day period has elapsed", whatever that means...
So, it is vague. I think if the gap in employment is less than 30 days, regardless of the gap in learning, I wouldn't use a BIL (unless it covered more than two calendar months, of course)
If the gap in employment is more than 30 days, I think you have to use the Last Day In Learning as the act end date? Like, that's what we do for every other BIL, right? If someone breaks their leg and is going to be off for three months, we'd set it to LDIL, not the date they broke their leg, wouldn't we?

Good analogy with the broken leg :) Yes, agreed - we always use the last date of learning for other breaks in learning.
I think the confusion for me is the interaction between the two dates. When employment ends, the 30-day clock starts from the date employment is lost, whereas the break in learning would ultimately be recorded from the last date in learning.
It’s really about how best to manage that period in between, particularly as you don’t know at the point employment ends whether the learner will secure a new employer within the 30 days.
I wish all the help-desk answers were as clear..

Break in learning after 30 days - loss of employer

Hi all,
Could I get some general feedback on the following scenario?
We have a learner whose last active learning date was 18 July 2026, with a loss of employment date of 15 August 2026.
Based on the funding rules, what date would you use to place the learner on a break in learning?
The 2025/26 Apprenticeship Funding Rules, paragraph 273.1, state:
“Where new employment has not commenced within 30 days, the provider must, after 30 days, record the apprentice as on a break in learning.”
I raised the question of the actual break in learning start date with the DfE helpdesk and received the following response:

“Thank you for contacting the Apprenticeship Service Support Team, my name is Ian.
I understand from your email that you are querying the start date for a break in learning as the apprentice did not find new employment within 30 days.
You would apply a break in learning and use a date after the 30-day period has elapsed.”
My question is therefore: what actual date would you record as the break in learning start date?
Would you record it as:
the day after the 30-day period has elapsed;
the date employment ended;
the last date of active learning
Interested to hear how other providers are interpreting and applying this in the ILR correctly.
