Functional Skills flexibilities until 31 July 2021

Hello,

I was wondering if you can support me with the guidance regarding Functional Skills flexibilities up to 31/07/2021.

The guidance states the below:

Functional Skills Qualifications (FSQ): temporary flexibilities until 31 May 2021 P160 From 25 February 2021, eligible apprentices can temporarily take their end-point assessment before achieving the required functional skills qualifications. 

P161 To be eligible to take their end point assessment before achieving the required functional skills qualifications, the apprentice must: P161.1 not be on a break in learning (an apprentice may return from a break in learning to take their end-point assessment); 

P161.2 meet all other gateway criteria to progress to their end-point assessment as specified in the apprenticeship standard (except functional skill qualification achievement); 

P161.3 have been confirmed by you and their employer as ready for both their end-point assessment, and to take a functional skills qualification assessment; 

P161.4 have exhausted all possibilities to access FSQ assessment via face-to face and remote assessment; 

P161.5 start their end-point assessment between 25 February 2021 and 31 May 2021 inclusive; and 

P161.6 provide a written declaration of their intention to take the required functional skills assessments within three months of starting their endpoint assessment. You must keep this in the evidence pack.

Then there is the flow chart to find out if an apprentice needs to do functional skills English and maths.

My questions are:

1. Do we still have to provide a written declaration of their intention to take the required functional skills assessments (level 1 for programme at level 2 and level 2 FS for level 3+ programmes) within three months of starting their endpoint assessment after 31/05/2021?

2. Does the learner (if completing a level 2 qualification) must attend (but not achieve) level 2 Functional skills within three months of starting their endpoint assessment?
