If an apprentice signs a contract of employment a couple of days before the first day of evidenced learning should their employment status be recorded as:

Employment status prior to enrolment - 10. In paid employment?

If so would that exclude them from applying for the apprenticeship service incentive?

No as the start date on the Apprenticeship Agreement can be before the start for the Practical Period which is used in the ILR as the programme start date.

Do you know if there is a set timescale of what is allowed between the employment start date and the start of the apprenticeship practical period start date?

Secondly, on the ILR status before enrolment would it be employed or not employed.

It depends what date you put in for employment status prior to the start (if one day prior to ILR start then employed would be correct), the reason for the two dates (start and practical period) is to allow for the employee to be employed under an apprenticeship agreement even though they may start learning latter.

Would not expect there to be a long delay, normally time it takes to set up DAS and get all ducks in a row before training starts, this should not exclude them from applying for the apprenticeship service incentive.

Thank you Martin.  I agree.  I would only expect as a maximum, within one week, even though the Apprenticeship Agreement has to be signed before or on the Start Date, (but which start date).  I think it just gets confusing for people when there are more than one start date to start confusing things.  I do wish they would make it just simple so there can be not discussion and it is what it is!

Hi Guys

Just a quick follow-up question I am being asked.  If employed prior to starting their evidenced learning with us (the provider), except for the the sign-up documents etc, do we need to collect any other form of evidence from the employer between these two dates?  I understand that payments will not start until they start their practical period as this is the start date on the ILR, but I am being told that they possibly could start some legit training towards their apprenticeship with their employer before starting official learning with us.  I know what my answer is, but would like to hear what others think!  Thank you

They could start some legit training towards their apprenticeship with their employer before starting training with the provider and this would be recorded as the start of the practical period (as recorded on the ILR as the start date) as training towards the Apprenticeship can be with either/both the employer and provider.

Morning, QQ? Can an employee start their first day of practical period of training on their first date of employment ? It's not something we would usually do as employees usually have an induction etc prior to the learning start date. However, the employer has asked if we can do the engagement workshop on their first day to save them coming into the office two seperate days? I think it's a hybrid WFH role. Many thanks in advance for any guidance

Yes as long as some training towards the standard requirements (SKB) or maths/english takes place in the workplace or with the provider and is evidence by OTJ training.

Do you know if an apprentice can start their apprenticeship 4 weeks before starting their practical period?  Simply put, start their new job with a contract of employment to be an apprentice but on the App Agreement and ILR, practical learning starts 4 weeks later?  Are their any time constraints between the 2 dates?

Again, possibly another stupid question, but I've just started a new job with a new employer and they are completing the ILR Employment Status fields differently, and yet neither and/or have been picked up as warnings/error, so would like a bit of advice.

Employment Status Prior to Enrolment.  If this is completed and there are no changes to this status, does the "Status on Day One and/or Updated Status" need to be completed?
