So am I right to say that if they start employment before 1/8/2021 but apprenticeship starts 1/8/2021 I won't get this error because I have put another new apprentice on who started employment on 11/5/21 but apprenticeship start date is 2/8/2021

Or should I not enter any new apprentices starting from 1/8/2021 on the 2021 ILR Tool?

You can still include them in the tool but you should tick the don’t Export box to exclude them from the 20/21 ilr.
