Under the new settled/pre settled rules for EU nationals are providers asking learners to prove they have been resident for the last 3 years, in addition to asking for the code to verify they have pre or settled status? Or are you accepting their self declaration for the 3 years evidence ?

Haven't seen anyone say the Service Desk have replied to their queries about this.

By definition, anyone with Settled must have been here three years but I think, even for Pre-settled, I'd take the three years as a self-dec, as we always have...

Another question about EU nationals. According to UKCISA (link in the AEB funding rules), settled status under the EU settlement scheme is also referred to as indefinite leave to remain. 

If an individual hasn’t been in the UK for 3 years, spouse has obtained settled status under EUSS (and apparently has indefinite leave to remain), would the individual be eligible for funding under paras 41.4 and 41.8?

I'm no Home Office but I believe ILR for EU nationals i.e Settled Status is different to the type of ILR granted pre Brexit. Its my understanding if they are a spouse of someone with ILR post brexit they do have to be resident for three years. Worth checking when ILR was granted to see if they gained it through post brexit or fall under the list of exemption categories
