On the bright side Dave, at least they've told you! Had plenty of examples of this where kids have just wandered in with a certificate in January...
It is A Difficult Situation because I guess you've got them on GCSE as well? Then, if they get a 4 in the resit, we're meant to withdraw the aim and update their learner level grade field (which always seems like an unnecessary penalty to me...) but, obviously, if they get another 3, you need to keep on teaching them til the exams next June...
Well CoF isn't finalised til the end of the year? If you're not currently teaching them GCSE that's fine, don't put it in and then if they do only get a 3 in the resit, you can start teaching them once they've got the result, and then they will meet CoF after six weeks (it only gets super gnarly if they withdraw entirely during that six weeks), CoF doesn't rely on the learner doing E&M all year, just at some point.

GCSE resit at school

Hoping experts out there can confirm this is ok - I have alerted our contracts manager just in case. We have a 16 year old starting a Traineeship, they failed a GCSE at school, and school have already entered for a resit and want the learner to do this with them. Funding guidance states resits are not usually funded, I assume this is same with schools so not double funding? I'll work out how the heck to code on ILR so doesn't fall foul of COF.
Any advice appreciated.
