English HE learner studying remotely in Scotland enquiry

We have a learner studying a HND with ourselves (in England), but the learner now wishes to study remotely in Scotland. The learner is sponsored by their employer who are based in Scotland (hence their move to be closer). The learner's aim is being solely funded by their employers, but would an English-based learner studying remotely in Scotland, still be a valid one? Naturally, their address may cause an issue, but I have yet to find any legislation to back this up.

If it's solely employer-funded, it's not a problem at all.
Assuming it's FM 99, I don't think it will even show in the PDSAT report that shows your Scottish and Welsh learners (which are not *automatically* non-funded anyway).
