Hi Can I ask for some advice.

We have an employer with some potential apprentices but they are on an FTC for 24 months. The standard will take24-26 due to gateway and exam series dates. If we have a letter from the employer to say they will be issued a contract extension would this create a problem? The employer does not issue contracts longer than 24 months due to internal factors. We cannot shorten the program nor will the learners achieve earlier as exam dates and EPA opportunity dates are set by the membership body. I know the rules state until end of end point but if the initial contract isn't long enough then its technically a no. But if we have a commitment from the employer to issue a variation/extension at month 24 will this be against the rules ?

Ask them to complete an Apprenticeship Agreement that covers the whole planned duration.

Hi Martin,

Would the Apprenticeship Agreement take president over the Apprentice's fixed term contract?

For example if they are on an employment contract for 24 months months but the Apprenticeship Agreement is for 26 months.

Yes as the Apprenticeship Agreement does not infer continued employment on completion of the Apprenticeship.
