Yes, it's a bit odd that BNO is listed in the 16-18 rules as, by definition, anyone born after 1997 can't have it (still rather shocked that someone born in 1999 could be over 18, but there we are!), so I'm guessing it must be referring to dependants (although someone in this position would also be 40. a or 40.d?)? I suspect it's because they like/need to the eligibility to reflect Education (Fees and Awards)(England) Regulations 2007?
But yes, for adults with BNO, they are effectively non-EEA with the right to work here, so same 3 years as any other working visa.

My interpretation of the funding eligibility for AEB would be that learners with a BNO passport/immigration status would not be eligible for funding. Without 3 year residency or any spouse/parent with traditional leave to enter/remain, I can't see that they would fit under any category... Is that correct?
For 16-18, the BNO is specifically mentioned as acceptable - but would that stretch to dependents of such?
