Change of Employer - ACT 2

Good Morning All, 

We have an apprentice who has now changed employer, they are currently on ACT 2 as they Started before the requirement to reserve funding through the digital account. 

They have now moved employer with no break in employment and learning, are we able to keep them on ACT 2? as the new employer is an SME and there has been no break OR do we need to stop the act 2 within the ILR putting them as ACT 1 with a Apprenticeship service cohort?

I am assuming the 2nd option but with a head full of cold I would ask advise incase I am missing something simple :)

No! It's definitely the first one! The money for that learner is in your carry-in, so you can continue to claim it from the contract, even though they've changed (non-levy) employer :)

Hi, quick question in relation to this - we have an apprentice who changed employer in 20/21 but it wasn't processed on our ILR.  They were originally with a small employer and ACT2 (prior to having to be on DAS) and the employer they are now with is Levy, so am I right in assuming that the ACT will need changing to ACT1? Thanks

Hi Christine Gregory - did you get a response to this? I have a similar situation. Not sure whether moving them to ACT1 with new LEVY employer will reduce our contract carry in provision, as we have a small capping and this would help? Steve Hewitt I don't suppose you are able to help at all with this scenario please? TIA

If the new employer is LEVY, we've always had to update their ACT, haven't we? We only get to code as ACT 2 if it's non-levy to non-levy?
