Apprentice employed by 'Employer of Record'

Hello,
If we have a potential apprentice who is working for a US firm (no UK presence), but is based in England for all of his working time (therefore more than satisfying the 50% requirement), would he be eligible for an apprenticeship?
Also, he mentioned that the employer might soon be employing him through an 'employer of record' so he will technically be paid by a UK firm.
In either instance above, would the learner be eligible for an apprenticeship?

Yes it could be they are employed by an ATA as an employer of record and as such the ATA is regarded as the employer and funds would be drawn from the ATA’s DAS account. If so you need to Record code LDM130.
