Traineeship Maths & English Condition of Funding

Hi All,
My organisation is currently facing a problem with traineeship learners who have a large disparity between their initial assessment results and their prior attainment. This has always been somewhat of an issue, but since schools have had to use teacher-assessed grades for GCSE results, we have found that nearly all our applicants are working below the level they have already achieved in school. On the one-hand we don’t want to set these learners up to fail, by enrolling them on aims which are too difficult for them. But on the other hand, we need to make sure they are enrolled on valid qualifications which meet the condition of funding.
I was hoping you could give us some clarification on the Maths and English condition of funding for 16-18 Traineeships in a couple of different scenarios:
Can a learner be enrolled on a Functional Skills aim which is equivalent to or below the level which they achieved in their GCSEs?
E.g. a learner who achieved Grade 2 at GCSE and has been assessed as currently working towards Entry 3. Can we enrol them on Entry 3, or does it have to be Level 1, or even Level 2?
Can a learner be enrolled on a Functional Skills aim at the same level or at a level below what they have already achieved in Functional Skills?
E.g. a learner who achieved Level 1 Functional Skills and has been assessed as currently working towards Entry 3. Can we enrol them on Entry 3, or does it have to be Level 1, or even Level 2?
And finally, a longshot:
Instead of a Functional Skills aim, can a learner be enrolled on a non-accredited aim, designed to plug skills gaps in Maths and English? We have found that learners enrolled on longer programmes (which are necessary if they are to have any hope of passing FS at a higher level than previously achieved), are less likely to remain engaged for the duration, and less likely to progress. Therefore, we would just like to check if it is completely necessary for a learner to be enrolled on a Functional Skills aim. The funding rules talk about ‘studying towards a pass in Functional Skills Level 2’, but could this include non-accredited work designed to plug the skills gaps?
