You will need to use legal sex and name:
The ILR specification says to record the legal sex of the learner.
Given names:

The name recorded in the ILR should be the same as the one used for the LRS. A verification report will check for consistency between the ULN recorded in the ILR and the LRS.
The LRS guidance on names is:
13.2 Names
Always use the learner’s legal name and not nicknames, as these can be recorded in ‘Preferred Given Name’.
I don't think there's *really* a precise point where someone transitions is there?
Neither is there *really* a legal name, a name is what someone wants to be called (this isn't a "freeman of the land" thing or anything, there really isn't any proper requirement legally).
My usual advice in these circumstances is to explain to the learner that there will be a certificate that will be produced when they're finished and do they want it to have their new name on if the dates won't tie with eg what their passport says at that point, for when they might want/need to present it to future employers?
I'm pretty sure ESFA don't care.

We have an apprentice who is starting their transition journey today, however they won’t legally transition until after they have completed their apprenticeship. I believe we’re not able to get their certificate in their new name as it’s not yet a legal change (I’m checking that out though) Are there any ESFA rules around which gender and name we register them on Pics with? TIA
