Appointing an apprentice in their final year of university

Can you assist please and provide a definitive answer to my query below.
We would like to appoint an apprentice in a marketing role. However, this person is completing the final dissertation year in Criminology in flexible circumstances.
Are we able to employ this young person as an apprentice in a marketing occupational role and if so, are there any conditions we must observe.

See below from the Apprenticeship Funding Rules:

P79.3

be in receipt of any other direct DfE funding during their apprenticeship programme; this includes any other DfE funded FE / HE programme including programmes funded by a student loan, but excludes funding outlined in P79.2; or undertake any part of an apprenticeship whilst on a sandwich placement as part of a degree programme.
