Change in employer whilst on BIL

HI

We have a learner who is on a break in learning but is changing employer, and the new employer wants to continue the break until the learner has passed probation (so a further 6 months down the line). Is this permissible, or will it need to be processed as a withdrawal and (potential) restart? 

The change in employment dates will be under the 30 day limit but I can't see guidance around how this is affected by the break.

Gut feeling is that it's not allowed but want to find a justification for it rather than lose the learner.

Hi Jim,

Unless they started in a contract year where the funding rules allowed a change of employer during a break in learning (pre 20-21 I believe). I don't believe they are able to take on the learner during a break in learning and it would need to be a withdrawal then a "restart" once they are ready to commence. 

That's my understanding and general feeling around this query, hope it helps

This learner started in May 2021 so if this is no longer permitted we'll have to process the withdrawal.
