Change of parent company, but not direct employer

Created

None

We have apprentices working for an employer, who are levy paying in their own right, while also being part of a group.

Paperwork, levy account etc are all in the name of the direct employer, not the group.

They have just been bought out by a new group, & the new parent company want to move the funding to their account.

As far as we are aware, the apprentice's employment contract will not change - they are employed by the direct employer.

I'm aware of what needs to be done in the Apprenticeship service/ILR.

What isn't clear is what needs to change paperwork wise.

I would think that contract / price documents do need to be re-done, but that App agreement / Commitment Statement wouldn't, as this a moving around of the funding, & nothing changes from the apprentice's point of view, but I'm not 100% sure.

Or should we just push back and say "no, keep the funding as it is"?

If the parent company changes on DAS and they wish the funding to come from their account then this would be a change of employer even though the EDRS do not change.

You would need all new paperwork where the employer name on DAS has changed.

(I mean I'd probably ask nicely if they could not do it for mid-programme learners please...) Yeah, it's effectively TUPE and with TUPEd learners we have to treat it like a new employer...
