BIL while in Gateway

Hi 

An apprentice, who had just entered Gateway, went off o sick leave. It will be quite some time until they are back at work in order to sit their EPA. 

In the ILR they are a code 1 (continuing) and 8 (in EPA).

Can we process a BIL in the ILR?

Annoyingly, yes, ESFA made it clear two years ago that they expect to see a BIL even where a learner is in Gateway and no funding is being generated... It's an audit check now as well, so you better had...

Strangely enough - I have had a reply from ESFA - they have advised we can't put them on a BIL ....

Thank you for your query regarding the recording of a break in learning.

I can confirm that now the apprentice is no longer in the practical period of the apprenticeship, this should remain as outcomes 1 and 8 until they return to the programme.

You are not able to record a break in learning once all the learning activities have been completed.

I hope this confirmation is useful.

Any words of wisdom of where to go from here?

That kind of makes sense to me because how could you return them to learning when there is no learning to return them to - just gateway. How could you set a return ILR up when they're in gateway? Just a thought.

Oh sweet, I'm more than happy to be wrong on this one!!! :) I thought it was daft as well, but they were definitely pushing it 18 months ago.

But Steven .... what if you're not wrong and we've had incorrect advice (it happens!)  :)

As the reason for a BIL is to suspend funding then where there is no funding to suspend as learning has ended this advice from the ESFA would be correct.

We have the same situation as above where our learner is in Gateway (code 1 (continuing) and 8 (in EPA)). The Learner has now gone on Maternity early and cannot do the EPA until she returns (this could be over 12 months).

Does any one know it there is a time limit on sitting the EPA (or is this up to the EPAO) or can we leave the learner coded as above indefinitely?

Sue, they'll pop up on your AAF numbers once they're 180 days past planned end, but that's all I think (unless the EPAO has different rules).
