New job after redundancy
Created
Hi all
I'm looking for some clarity around the redundancy rules and hoping someone can help.
We have a learner who was made redundant at the end of November and are continuing to support during the 12-week period (which expires on the 22nd).
She has found a new job, which starts next week, so within the 12-week period - does learning at the new company have to have started by the end of the 12 weeks or is it sufficient to have started employment within that time and for learning to take place within the 28-day period? It's going to be tight to get all the paperwork etc signed and agreed by the 22nd so any additional time we can get would be helpful.
The new job will be within 12 weeks and the learning will be within the 28 days, but does the former take precedence over the latter?
This is the first time we've been in this situation so it would be useful to know if anyone else has experienced it.
Thanks
Jim

If its over the 12 weeks you should withdraw and then restart at the appropriate date but you can indicate on the Apprenticeship agreement separately the start date with the new employer and restart date (Practical period).
To clarify, the new job is starting within the 12 weeks but the first learning session at the new job may not be - is that allowed or does the new learning (and commitment statement, apprenticeship agreement etc) need to be within the 12 weeks?
