Hi we have a learner that just keeps failing one of their FS. Full diagnostic/skillscan IA was done and nothing shown and learner has declared no LLDD. This Apprentice is coming up to 1 year past PED. I have looked for the guidance as I am sure I have read exclusions happen after 2 ILR years but dont know where I have read it nor seem to find it ! Maybe I imagined it.
Any ideas or help ?

It is up to you and the employer to decide if the learner should continue or be recorded as a fail as there is no such requirement in the funding rules.
