Reimbursement of additional payments

Hello

Quick question (I hope), i can see clearly in the PSM guidance around reimbursing an employer in relation to co-investment payments but not around additional payments.  We had a backdated break in learning which cancelled out the second on programme additional payment so I'm trying to check whether we request this back from the employer or not.  Anyone?

The ESFA will claw back any payments due to a backdated entry in the ILR, your procedures for any reimbursement for any over payment to the employer should be included in your agreement with the employer.

Well, it will definitely get clawed back from your funding, so I suspect your finance director will probably want it back from the employer!

Suspect it will depend on the T&Cs of your contract with the employer (and I'm not sure what it says in the AELP "standard" one)? As you say, I don't think there's a *rule* about it...

I suppose if they return to the programme it won't matter so much, as you would still be entitled to it. However, if they don't then you are out of pocket, so it's probably better to try and resolve now.
