Part time to full time apprentice

Hi All. We have an apprentice who will be starting her apprenticeship on 21 hours per week for the first 3 months before moving to full time for the remainder. How would you recommend us setting her planned date on the ILR? We would of course usually extend if the apprentice was part-time for the entire apprenticeship.

You will need to calculate the average hours over the planned duration and if this is less than 30 hours per week then extend the duration as per the following.

P35 Where a part-time working pattern is needed, you must agree with the employer and the apprentice the extended apprenticeship duration. You must extend the minimum duration using the following formula:

P35.1 12 x 30 / average weekly hours = new minimum duration in months; or

P35.2 52 x 30 / average weekly hours = new minimum duration in weeks

It's going to depend on:

a. how long the apprenticeship is

b. how many hours she does when she goes full time.

because this is a planned thing, you can work out her average hours per week over the whole app and if that's over 30 (which seems likely?) then you don't need to extend it.

eg:

21 hours a week for 12 weeks (252 hrs)

35 hours a week for 41 weeks (1435 hrs)

1687 hrs in total divided by 53 weeks equals 31.83 hours a week, no extension necessary.
