I was hoping that was the case.
If a learner left before completing (early Leaver) then came back but was employed by a different Employer, I could code them as a restart but would the new employer then need a digital account and the coding be ACT 1 employer?

Yes as ACT indicates the type of contract under which this apprentice on this apprenticeship is being funded and not levy and non-levy employer, ACT identifies whether the apprentice is funded using funds in an employer's digital account through a contract for services between the provider and the employer (ACT 1) or funded by the ESFA through a contract for services between the provider and the ESFA (ACT2).

We have a learner who went on a break in learning just befor her EPA.
She was coded as ACT 2 (ESFA) on the ILR and her employer has not set up a Digital account.
She is now returning to complete her EPA. Can I just leave her on ACT2 (ESFA) and code her as a restart, therefore I would assume there would be no requirement for the employer to open a digital account
Any advice on this would be great
