Oh no, I hadn't realised quite how ambiguous P396 was! Is it the Family Member or the EEA National who needs Settled/Pre-Settled? Let's ***assume*** the latter (because the former doesn't make much sense), in which case, assuming he was in Italy for more than a year, it would appear he is fundable under 396.1.
ALSO, if he's 16-18, one of the categories under P411, probably P411.1, might help? I checked and, like Study Prog rules, there's no three year residency required under those categories.

Hi All,
I am hoping someone is able to help with an eligibility query.
We have an applicant who is Chinese but has lived in the UK since 2020 and previously in Italy. His father is living in the UK, and has been for 3 years + under the EU Settlement Scheme and can remain until 2025. His father is an EEA National (Italian passport) In this case would his son (the applicant) be eligible under the below funding rules:
Family members of UK and EEA nationals
P395 Family members of UK nationals are eligible for funding if:
P395.1 They (the family member) have been ordinarily resident in the UK or EEA for at least the previous three years before the start of the apprenticeship.
P396 Family members of EEA nationals who have obtained pre-settled or settled status under the EU Settlement Scheme are eligible for funding if:
P396.1 They (the family member) have been ordinarily resident in the UK or EEA for at least the previous three years before the start of the apprenticeship.
P397 A ‘family member’ is the husband, wife, civil partner, child, grandchild, dependent parent or grandparent of a UK or EEA national.
