I have noticed that the eligibility criteria for non-UK nationals has changed slightly.
Last year a non-UK national had to have permission granted to live in the uk AND have been ordinarily resident for 3 years. (P39.1)
This year it has changed from AND to OR. Is this correct or just an error likely to be changed back to AND.
If it is staying as an OR then wouldn't that allow learners with EUSS, or equivalent permission, to be funded regardless of meeting the 3 year residency or not, effectively wiping out the non-UK non-EEA national rule?
