Care employer different on AS to that of employer

Morning All

We have a care employer who is know as ABC Ltd and all correspondence/paperwork has been done with ABC details, but it has just been noted that the Apprenticeship service has the employer as XYZ Ltd, it's gone through R12 upload submission and the ILR details have no errors so it has linked the two ABC and XYZ Ltds with no issues.

CQC has the reports as ABC Ltd provided and run by XYZ Ltd.

So my question is who should be on our CFS as we have done ABC Ltd which we thought was the case, but now I am doubting myself.  The apprentice is paid by ABC Ltd.

As an aside really, "of course" the DAS/ILR link worked because, if you think about it, there's nothing *really* in the ILR that defines the employer (even before they killed EDRS), effectively I think it just looks to match ULN and then that whoever that learner is attached to on DAS has set you as the training provider...

I'm assuming ABC and XYZ *are* linked companies in some way here? I guess the key thing to check with them is the PAYE scheme matches, this is why it's been added to the Rules because this is where HMRC gets twitchy...
