Extended Min Duration Query

Hypothetical situation - 

20 hpw learner - no change throughout Apprenticeship - therefore min duration extended from 12 to 18 months.  That bit is a given.

the query - is - if the learner has completed all work, hours and requirements between months 12 and 18 (ie - ahead of extended min duration ped) AND the employer has declared that all hours were completed OTJ during working hours - can this learner go to Gateway?  Or can they only go once they have reached their original (extended) ped?

Where the 12 month min duration needs to be extended due to Part time hours then this becomes the minimum duration, and the Apprentice cannot complete before this point.

Thank you Martin - are you able to point me to the official wording on this?  I'm trying to make sure we are bullet-proof for if/when an employer questions this - especially in the example above - where they have allowed a learner extra time during programme to complete tasks/hours/etc

It all in the funding rules.

P35.3 The end-point assessment can only be taken after the minimum duration has been met. You must confirm this as part of the gateway checks.

Part-time employment hours (<30 hours per week)

P36 If, at the beginning of the programme, the apprentice works fewer than 30 hours a week you must extend the expected duration of the apprenticeship on the ILR (pro rata) to take account of this. You must work with the employer to make sure that the dates on the apprenticeship agreement and training plan are also extended.

P36.1 Where a part-time working pattern is applicable, you must agree with the employer and the apprentice the extended apprenticeship duration. You must extend the minimum duration using one of the following formulas:

P36.1.1 12 x 30 / average weekly hours = new minimum duration in months; or

P36.1.2 52 x 30 / average weekly hours = new minimum duration in weeks
