Ouch...
You know I don't say this very often, but I doubt they'd be fundable, even under the very broad Study Prog guidance... Is P 34 and 35 that we need to look at I think?
34. To be eligible for funding the student must have the legal right to be resident in
the United Kingdom at the start of their study programme. A person subject to a Home
Office deportation order will ordinarily be ineligible for funding until their situation has
been resolved to the satisfaction of the Home Office.
35. In determining student eligibility, institutions must also satisfy themselves that
there is a reasonable likelihood that the student will be able to complete their study
programme before seeking funding for the student. This should include the practicality of
providing a place for a student who may be unable to complete their programme if they
are likely to leave the country permanently during their study programme.
Whilst it doesn't sound like they're subject to a deportation order, they're also not really here legally... I *think* schools have broader remits so would be able to accept them if they were under 16, but our rules are pretty clear...
Unless... they fall under P40 d or e:
d. those who are dependants of adults residing legally in the UK who have been
given immigration rights as workers to reside in the UK
e. those who are dependants of foreign students where the accompanying
parent or legal guardian has a student visa
But I'm guessing, if they are with parents, that their visa has expired too?

Funding for a 16 year old that has overstayed their visa

A local organisation have referred a 16 year old that has overstayed their visa and has no evidence for seeking an extension or seeking asylum. The only documentation provided is a passport from their home country. They are suggesting that because the student is aged 16 they can still be funded.
Can anyone advise on funding for students whose visa has expired?
