1. No Recourse to Public Funds *never* applies to education.
2. Pre-settled people *can't* apply for Settled 'til they've been here five years, so it's not the learner's fault.
So, have a chat, if they're intending to stay and apply for Settled, sign them up.
(I've assumed here that this is an apprenticeship, it's explicit that pre-settled are fundable in Study Prog guidance)

Hi,
I have a potential learner who is Brazilian born, with a Portuguese passport that has lived in the UK for 4 years, however on his Visa he has Status Pre-settled status, also known as limited leave to remain Valid until 25 June 2024.
I think that this would have been ok under previous funding rules, but is it still ok under the new changes? just concious the guidence for Limited leave to remain says not recourse to public funds.
