The story is that potential learners Leave to Stay in the UK expired in June 2022 but he has been given a 6 month extension whilst his application for a further 3 years is looked at. Because the programme he would be going onto is 2 years long he is not eligible but does funding rule P369 cover this?

Yes, 369 covers it perfectly. Treat the learner as though they had the status they had when they applied, so, presuming they've been here three years, most likely eligible.
